BasicMed doc needed--Monterey/Santa Cruz CA area

I live in Kentucky. This state requires a licensed MD to do a Basic Med examination. In some states a chiropractor can do them. Each state has its own definition of a “licensed medical examiner”. Some CDL examining facilities also do Basic Med exams, however a CDL exam itself can not count as a Basic Med exam. AMEs can do Basic Med exams, although they tend to not do them, restricting themselves to 3rd, 2nd and 1st class medicals exams. It can be difficult to find an MD willing to do the exam. I found some by extensive searching online for my region.
The statutory term is "State-licensed physician." And yes, it varies from state to state.

To contrast the language in two, in your Kentucky, I think the only time "physician" is mentioned in the state statute licensing chiropractors, is about chiropractors referring patients to "physicians." OTOH, in North Carolina, the licensing statute refers to them as "chiropractic physicians."

I have no idea if is is accurate or not, but I came across this map somewhere. They probably should have chosen different colors given current US politics, but chiropractors are "physicians" in blue states; not in red states.

Okay, they're "on record." So? What does that accomplish?

Your goal, so you say, was to get your witnesses on record, but now you have no idea how to obtain that record? I'd say the effort was a complete waste of time, then.
I have the audio of that session.
Your SI was withdrawn. Here's the enabling legislation for basic med (from the Federal register 05/18/2024 and 07/14/2016)
View attachment 153047
See (a)(3) subpart (E). So your Basic is not VALID until you win a reversal of that withdrawal from April 2022.
The medical certificate was not withdrawn. The SI for cancer was withdrawn in an illegal attempt to deny my right to operate an aircraft. FISDO gave known false information to a federal agency. If you or I give false information to that same agency on our applications, it's a crime. This false information caused the FS to require a psych exam. I got the exam and gave it to my primary care physician, who issued my Basic Med. She renewed my medical for the next four years.

You clearly either can’t or don’t want to understand how this works. I don’t have the details on what happened within the FAA , but if your SI was withdrawn illegally, it was still withdrawn, and both the regulation and its underlying regulation say you may not fly under BasicMed until and unless you get that decision reversed.
Your PCP does not have the ability to override federal law.

Perhaps unlike some others, I feel bad for you. I’ve seen similar both in and out of aviation.

The SI for cancer was withdrawn.....

Okay, it was withdrawn. Now read the regulation concerning Basic Med:

CFR 61.23(c)(2)(iii)
The most recently issued Authorization for a Special Issuance of a Medical Certificate cannot have been withdrawn;

Clearly, you are not allowed to use Basic Med. It matters not one bit what your physician signed or said. You really need to sit down and read the regulations.

The preamble to Feb 10, 2022, a letter that you have published, tells it all. Minimally excerpted here:

So, your SI auth was withdrawn due to failure to provide required information.
Provide it, resolve the withdrawal and you can fly on Basic again. That is your path forward.

To the OP, I apologize for this hijack and hope the you have found a basic med provider.

You can look up your medical status, among other things, on the FAA Web site here:

When I look up my own listing there, it shows the date of my last FAA medical certificate, and the date of my last BasicMed qualification. If you don't see both of those on your listing, then you are playing with fire if you continue to fly under BasicMed rules. Asserting that laws were broken is not sufficient to grant you flight privileges.

Dr. Chien is an expert on the subject of FAA medical qualifications. You should heed his advice.

He admits the FAA demanded he send the certificate back. That's pretty compelling indication that they withdrew it.

AOPA BASIC MED FA QUESTIONS.

Should I plan to surrender my current unexpired medical certificate in order to fly under BasicMed to avoid possible future action by the FAA if something happens and my current medical application has not yet expired?

You are not required to surrender your valid medical certificate to fly under BasicMed. If you hold a valid medical certificate and also meet the requirements of BasicMed, you can choose to fly under the BasicMed rules. However, even if a pilot chooses to operate under BasicMed rules and is not exercising the privileges of his or her medical certificate, the FAA still has the authority to pursue enforcement action if there is evidence that the pilot does not meet the medical certification standards for that medical certificate. Generally speaking, a pilot who knows or has reason to know of any condition that would make them unsafe for flight must ground themselves whether they hold a medical certificate or fly under BasicMed. So, before you surrender any airman certificate, consider contacting an attorney experienced in aviation-related legal matters.

From February 10th, 2022, my second class medical was in my pocket and in full force until April 26th of 2022, when I voulentunally surrendered it. The medical was not revoked, suspended, or withdrawn, Period.

When they tell you to send it back and threaten criminal prosecution if you don't, it's been withdrawn. You can weasel all you want but your "evidence" demonstrates it is patently illegal to fly basic med. Nothing in your AOPA quote (which is by and large meaningless legally, AOPA's opinions have no validity in the enforcement/legal process), contradicts the basic facts.

The letter of 04/12/2022 sez it all. They used the language that they "withdrew your authorization". So, per section 2307, "(a)(3) subpart (E)" from my earlier federal register excerpt, A basic is not good for anything, no matter what you did or how you want to frame it, or what you subsequently think you did. Attached, is what they send you if you obtain a basic (of which there is no record so I'm assuming you don't have one):

It arrives certified and then they will take away your ATP, Your Comm, your PVT, your CFI, and your IR. The Marshall service will come an obtain them from you if you do not cooperate and that is "quite the event" and a "real scene". They are professional but they will treat you like a street kid from Dorchester - don't go there. Don't resist- that's a Felony if they choose. I have seen a defiant machine tool shop owner lifted up by his shoulders by two big burly armed guys and carried to the van, by a pair of agents, in front of his 100 odd employees. I think being locked in the back of the van and being taken to his Suburban home, gave him time to grow up and he produced the certificates....and did not get prosecuted (Felony resisting). But I can't un-see what I saw. He shared you attitude.

So the fix is to get the items listed in the letter of Feb 10, 2022, reapply, win, and then go to basic. The crux of this is, behave like a Rotch, a Coffin, a Starbuck, or a Gardner, play by their rules and win. Remember, you are not on a street in Dorchester....unless you make it so.

Bob, see this right here? Your information on the FAA website? https://amsrvs.registry.faa.gov/airmeninquiry/Main.aspx

1783183376846.png

IF you had a valid medical certificate, or an expired one, and IF you had Basic Med, it would say so in the circled spot. YOU DO NOT HAVE BASIC MED NOR AN FAA MEDICAL. It is not legal for you to fly.

As a comparison, here's what mine looks like:

1783183593911.png

See all that good stuff showing I held a third class medical, now expired, and showing that I had a Basic Med exam on 6/11/2026 and completed the Basic Med course on 6/12/2026? You ain't got that. Consequently, you are not legal to fly under Basic Med.

Furthermore, let's take a look at the letter dated April 12, 2022, which you posted:

1783184327706.png

I don't know how this could be much clearer. Unless you jump through the FAA's hoops to restore your medical certificate, it is unlawful for you to fly.

Yep, I looked him up first thing. Arguing what one believes are "technicalities" against those who wrote the rules is a losing game, always.

..and these aren't even "technicalities."

But if I understand his argument, it's that since the termination of all his medical privileges was the result of the FSDO lying, so none of that counts and he can pretend it didn't happen. I saw the equivalent type of reasoning during the recession by people who lost everything. It was very sad to see.

Actually, what I wonder is whether he ever did the required course. The FAA gets notified of that (which is why your dates are in the public record), so I would expect it to have generated an FAA nastigram pointing out he wasn't eligible for BasicMed.

As I am 81 years old, I have no desire to do any further commercial flying. So I will not correct the problem for my second-class medical. Even though I could pass a first-class exam tomorrow. As my basic medical and the SI was still in effect, I fixed the new problem with my primary care physician at the time. Now, I cannot fly my twin-engine 402, and I cannot go to Canada, which I am going to have to live with.

Correct. They gave me 14 days to surrender the unexpired Medical Certificate, and I did so on the day required.

They copied over the February 10th letter, page two, with the second letter with the surrender requirement.

Did you take the course that is required in order to complete the BasicMed process?

Read the real pg. 2; it says not to operate while a known medical deficiency is present. I'm fine and have been for the past 60 years of flying.
But you still have no medical (FAA or BasicMed) of record. Unless you just got reinstated, and it's not yet on the FAA website (I'm in that process now.)
A doctor signing a BM form is meaningless otherwise.

Correct. They gave me 14 days to surrender the unexpired Medical Certificate, and I did so on the day required.

And for that reason you were not referred to FAA legal for enforcement action.

But that hardly means you had a valid medical.

No, that's not true. Your SI was pulled. Your primary care physician CANNOT fix a problem you have with the FAA. The FAA requested info from you, you did not provide it to them, they pulled your SI and thereby made it impossible for you to use Basic Med, and until you resolve that situation with the FAA, you cannot fly legally.

Regarding

I suggest you read 14 CFR 61.23, paying particular attention to (c)(3)(ii) and (iii):

(ii) The most recently issued medical certificate—

(A) May include an authorization for special issuance;
(B) May be expired; and
(C) Cannot have been suspended or revoked.

(iii) The most recently issued Authorization for a Special Issuance of a Medical Certificate cannot have been withdrawn; and

Your SI was pulled, and the FAA revoked your medical certificate. This is clearly stated in the letters you received. Basic Med is unavailable to you per both (ii)(C) and (iii).

And for that reason you were not referred to FAA legal for enforcement action.

WRONG! MY ATP, MEDICAL, OR TSA BADGE HAS NEVER BEEN REVOKED. These are some of the lies the airport Counselor has his client state under oath. Wrong. THIS is the revocation of your medical:

Bob, so far you have received two letters from the FAA that revoked your medical. In this thread alone, you have been told by a representative of the FAA ( @Brad Z ), by a senior AME ( @bbchien ), and by an attorney who practices aviation law ( @midlifeflyer ) that you are not eligible for Basic Med. So far, I haven't seen one single person agree with your position.

Is everyone except you wrong?

by an attorney who practices aviation law ( @midlifeflyer ) that you are not eligible for Basic Med
Actually, I haven’t. At most, if the official documentation he’s posted - the withdrawal of the SI and the instruction to surrender the medical - is the complete story, sure. That’s pretty obvious from the regs. And I can feel comfortable saying that claiming it was all due to a fraud and unproven criminal behavior doesn’t change that result unless and until the FAA or a court agrees in a final judgement.

But beyond that? Legal advice is a one-on-one event in which the main job of the lawyer is to ask the right questions. I don’t know enough (and don’t want to).

I am operating under Part 68.

That doesn't entitle you to ignore the requirements of 14 CFR 61.113(i) and 61.23(c)(3).

§ 68.1 Applicability.
This part prescribes the medical education and examination requirements for operating an aircraft under § 61.113(i) of this chapter without holding a medical certificate issued under part 67 of this chapter.

§ 61.113(i) A private pilot may act as pilot in command or serve as a required flightcrew member of an aircraft without holding a medical certificate issued under part 67 of this chapter provided the pilot holds a valid U.S. driver's license, meets the requirements of § 61.23(c)(3), and complies with this section and all of the following conditions and limitations...

§ 61.23(c)(3) A person using a U.S. driver's license to meet the requirements of paragraph (c) while operating under the conditions and limitations of § 61.113(i) must meet the following requirements:...

(ii) The most recently issued medical certificate—
(A) May include an authorization for special issuance;
(B) May be expired; and

From Feb 10. The agency disagrees with you. What you are doing is beating your chest with your fists and yelling "but I'm fine". The path forward is to obtain the evaluations they demanded and pass. I have pilots that succeed at that every month, and some that fail. But right now you have no way to operate, part 67, or part 68. And the withdrawal locks you out of LSA-mosaic operation as well.

Your pilot certificates can be and will be revoked if you do operate at all.
Just remember, Congress gave the FAA the air. It's their ball, their stadium and their league. You need to respect that.

The reason you are not listed with the BASIC med, if your doc signed you off, is that you never took the on line course and never printed the graduation certificate that you need. But If you go onto AOPA's site and do the basic med course, you will provoke the Basic Med Inquiry certified letter and be informed that your PILOT Certificates will be disciplined.

Very clever of you to get a sign off but to not do the course, but it doesn't matter. Unless you have the course graduation certificate and it matches your ID, you don't have a Basic med. When you get the course graduation certificate, the site informs FAA and all the alarm bells will go off.

Late add: and I'll be you didn't know that airport mangers are empowered to do a ramp check!

I took the AOPA course. I have a graduation certificate and they sent it into the FAA. My primary care doctor reviewed my medical information and completed the CMAC. I have my basic med.

Congress writes the laws, the FAA interprets the laws and regulations. Everyone must follow the written laws and pilots must follow the written regulations. FAA agents and state police can approach my airplane without probable cause. Airport managers need probable cause.

If those were the only two requirements to operate under Basic Med, you'd be good to go. But there are other requirements that you can't satisfy.

This thread has probably run its course. It's clear that the legal requirements - things like the most recent medical certificate not having being withdrawn, suspended, or revoked don't matter to him. He only recognizes two criteria as legitimate - his PCP's signature and the completion of a short multiple-choice knowledge test.

Or, as Paul Simon put it,
"All lies and jest,
Still, a man hears what he wants to hear,
And disregards the rest".
