BasicMed doc needed--Monterey/Santa Cruz CA area

My basic med was not affected by the illegal removal of the SI. My medical was not yanked. I reported the finding of the psych exam to my primary care physician in a timely manner. She evaluated it and gave me my basic med. It is good until 2028.

Do you understand how Basic Med works? You can’t use Basic if your medical was invalidated, which it was.

Not when your medical has been withdrawn. It matters not that the basic med was valid when it was issued, if you had an unsurrendered/unexpired medical and it was withdrawn, you can not fly on basic med.

And it doesn't matter if thw withdrawal was appropriate or not. That was something you could (potentially) fight and get reinstated, but for as long as it was withdrawn, you're illegal to fly.

It isn’t. Basic Med is an alternative to a medical certificate. It’s becoming apparent that you don’t understand the regulations.

Regardless of whether the termination of your medical certificate was justified, the fact is that it was indeed pulled, and that takes Basic off the table until you can get your medical back.

My MEDICAL was not withdrawn. My SI for cancer was illegally withdrawn.

You really don’t seem to understand this. Without the SI, there’s no medical certificate. That’s why the Flight Surgeon told you to surrender it and advised you that you couldn’t fly without a medical.

The Flight Surgeon is legally authorized under the CFRs to request information from you if the FS receives adverse info about you. You failed to provide the requested info, and therefore your medical was pulled legally. You no longer have a medical and Basic Med is therefore not an option for you.

Basic Med requirements:

CFR 61.23(c)(2)(iii)
The most recently issued Authorization for a Special Issuance of a Medical Certificate cannot have been withdrawn;

I am not applying for a basic med. I have a current and existing basic med. I have been using it for the past three years and I intend to continue using it until I am not qualified.

You became “not qualified” when the FS pulled your SI and told you to surrender your medical.

@Brad Z , could you please explain this for Mr. Walsh? Apparently I’m not making it clear

That's not the way it works, Bob. You don't get to ingore FAA actions because you declare them to be illegal. Basic Med isn't a "I was qualified on the date of exam so I am good for the next four years unconditionally." The statement about the revocation of the most recent medical applies to EVERY FLIGHT. When they tell you to surrender your medical certificate, it has been withdrawn. You can weasel all you want, but you can not operate basic med.

BasicMed isn’t a certificate. It’s a collection of regulations (61.23(c)(3), 61.113(i), Part 68) that must be complied with in order to operate an aircraft without a medical certificate. If your most recent special issuance has been withdrawn (see 14 CFR 61.23(c)(3)(iii)), you cannot operate under these provisions…regardless of the status of the special issuance when you first started operating under BasicMed.

I've noticed that the way that BasicMed requirements are scattered around in those regulations means that very careful reading is required in order to understand them. Is the FAA's BasicMed FAQ still valid?

If someone knows this fool and sees him acting as PIC, please call the FAA. He is a risk to himself and others.
The FAA has been following ALL my flights for the past eight years. They use ADS B, and when I land, they have an airport vehicle come out and see who’s on the airplane. They request videos on every flight I do. Airport managers are refusing to deal with them. The last Airport manager at Nantucket has left after a year on the job. He gave my request for a hearing to the criminal lawyers.

It sounds like they are documenting the fact that you continue to fly. Regardless of what you believe, if what has been posted here is correct, you have no medical clearance to fly--not a class 1,2,or 3 medical certificate OR BasicMed. You should be careful--you could end up losing everything.

This is called criminal harassment. I took the case to criminal court because of it. Their criminal lawyer intimidated my witnesses, coercing them to say what he wanted. I was also representing myself in this case.

Uh, unless you’re a prosecutor, how did you take a case to criminal court? Please post a copy of the court’s ruling.

Do you know what they say about self-representation?

This guy is either clueless or trolling the crap out of us. BTW, because there's no medical info for him in the system, he's flat wrong about BasicMed.

That is what they said when I filed the case.

Yes it was Abe Lincoln. I mentioned that to the judge. All I was trying to do was to get my witnesses' statements on the record, and I achieved that.

That's an application for a criminal complaint (one of the quirks in Massachusetts law). It's not a trial. The clerk-magistrate just determines whether the complaint warrants bringing actual criminal charges. Seeing how there is no record of charges being filed against Mr. Karberg by the commonwealth, I suspect the court was unimpressed by your claims.

Case number 2488AC000339 . The "AC" denotes that this was a civil court, so why do you say criminal court? How about posting the court ruling, or at least a link?

Like I said, I was just trying to get my witnesses on record. And I did. What I also got was that attorney intimidating my subpoenaed witnesses. She denied probable cause.

Okay, they're "on record." So? What does that accomplish?

How do I do that? You obviously know more than I do.

Your goal, so you say, was to get your witnesses on record, but now you have no idea how to obtain that record? I'd say the effort was a complete waste of time, then.

I didn't realize that's still online; the link from the BasicMed page was removed. It's a bit outdated with the changes with safety pilots, examiners, and expanded covered aircraft. A new AC should be published shortly with all of the updates.

No, it doesn't. @flyingron is quite correct. It denotes that it was an Application for a criminal Complaint.

As Ron said, Massachusetts criminal procedure allows private parties (not the police or the DA's office) to come to the District Court Clerk/Magistrate's office and apply to have a criminal complaint issue against another person. Probably has colonial roots.

The Clerk/Magistrate will hear testimony and review submitted documents and determine whether there is probable cause to issue a criminal complaint. They added to uniform standards years after I left the Commonwealth, but I doubt it's significantly different now than when I practiced there. Often there is some type of hearing, formality of which can vary a lot. I've seen 10 minutes of ranting followed by a "no." At the opposite end, there have been politically-charged ones where there was a full day of testimony with multiple witnesses and the case got assigned to a judge to avoid the appearance of bias.

I wouldn't expect a public record unless a criminal complaint issued.

I think all that's left for you to do is try the sovereign citizen defense at this point...I mean, you're already in so deep, what do you have to loose?
I just checked my pilot certificate, and my name is in all caps. Does that mean that the FAA has no jurisdiction over me? ;)

Ah, thanks for the correction. Looks like there was no evidence of a crime.
Apparently not enough presented by the complainant to convince the magistrate.

As you might imagine, many of these are personal grudges and can get pretty hot.

Apparently, Google never forgets!

I live in Kentucky. This state requires a licensed MD to do a Basic Med examination. In some states a chiropractor can do them. Each state has its own definition of a “licensed medical examiner”. Some CDL examining facilities also do Basic Med exams, however a CDL exam itself can not count as a Basic Med exam. AMEs can do Basic Med exams, although they tend to not do them, restricting themselves to 3rd, 2nd and 1st class medicals exams. It can be difficult to find an MD willing to do the exam. I found some by extensive searching online for my region.
