BasicMed doc needed--Monterey/Santa Cruz CA area

I couldn't find anyone in my area that would touch anything associated with the letters FAA. Even Dr's that signed off CDL physicals said no way. Told my GP what was involved, the pickle I was in, and the process. He reluctantly agreed.

Doctors on Duty on Ocean Avenue in Santa Cruz did mine last year. I called, the receptionist ask me to send of the form, the doctor checked it out and told me to come in.

This is interesting because I have never had an issue getting my primary care doctors (3) to sign off a basic med. I believe most of the time denials are occurring is because the pilot hasn’t established with a PCP or if they have established they don’t bother to even go in for the annual physical their insurance will pay for.

I just put in Google search "faa who does basic med in Monterey and Santa Cruz, CA" and it came up with a number of doctors.

And remember, an AME can do a Basic Med too, not just the regular 1st, 2nd or 3rd Class medical. The FAA has a database you can search to find someone close to you.

Been to that DR for at least 10 years. May have been he never did one. All the local minor emergency centers that do CDL physicals flat turned it down. I have had CDL physicals. Its basically the same except for those funny color test pictures.

Most AMEs (as in "all but one", apparently) will refuse to do a BasicMed physical outright. That said, I DID find the one AME who was willing to do it. He was not very close to me, but at that point I would have been willing to go out of state if I had to.

Clip4 is correct--doctors are very reluctant to do these physicals unless you are one of their regular patients and they know you and your medical history. In my case, due to my medical situation and the fact that the doctor didn't know me, he insisted on an in-office EKG and also recent blood test results (which I emailed). More rigamarole, but now I'm done.

Thanks very much to all who posted!

Tim

(BTW, I tried the Doctors on Duty on Ocean Street, and they refused.)

Interesting. I know someone that opted to go with the Basic when it came out. He just kept going to the same AME he had been going to for his 3rd Class.

I'd switch, but there is always that chance that I may want to go into the FLs for a brief time to get over Wx. But usually I stay in the 11-16K range, pending where I'm going.

My Primary Care Doc did my Basic Med exam. When I got to the car, I noticed he hadn't checked the box for "anus" on the form, so I went back into the office and the receptionist took me into an exam room. The Doc came in and I explained the problem. He laughed, rolled his eyes, and said "drop 'em and bend over. Yep, you've got one." He checked the box and I was on my way.

IIRC it can't be your AME though. In my experience, AMEs can be pretty rough, I would try to find a regular PCP first.

Why not? They already know you can, or at least have, passed the 3rd Class or higher. And the exam itself is pretty much the same for both, so I'm not sure why an AME would not do a Basic Med... Unless it was quite simple the time available and the cost. If they make less on a Basic Med and they are already slammed with more calls for 1st, 2nd or 3rd class medicals, then why bother since they're not required to keep you flying since you can go to any state licensed MD.

Yeah, you're right. I'm just used to AMEs being extremely skeptical and unhinged as the kids say.

There is, at least, a PERCEPTION that a physician signing off on a BasicMed physical is taking on a huge liability. If that is so, I don't understand why signing off on a regular medical certificate would be any different unless there is some kind of qualified immunity. I know that in my search for a doc, more than one AME cited liability as the reason for refusing to do BasicMed.

Subject says it all. Anyone know of a doctor in the area who will do BasicMed physicals?

You should have BOTH WHEN YOU ARE QUALIFIED! FAA has weaponized the medical system in the past. When they want to ground someone and they are highly qualified. Think Bob Hoover, he did nothing wrong and rogue inspectors kept him on the ground for years. My Basic Med is the only reason why I can fly. I been going through it for 8 years now and I can’t find a criminal lawyer to help. AOPA can only provide “Aviation” lawyers as even they are not willing to confront rogue FAA inspectors.

I have heard that there can be a problem for doctors trying to get liability insurance at a reasonable price to do BasicMed exams. Conversely, I have heard that the liability issue for AMEs is taken care of by the FAA.

Maybe your difficulty is that you don't seem to understand how the law works. A criminal attorney is one who defends people who are charged with crimes. There's nothing here that even remotely smells like a crime. Dealing with regulatory issues (and malfucnctioning regulators) is indeed something an Aviation attorney (or government relations attorneys) in general handle. It's not surprising why criminal attorneys don't give you the time of day with that request.

I Absolutely agree, the FAA (like most federal agencies) has let the power and bureaucracy completely go to its head. Look up John King of King Schools as well.

Unfortunately, a criminal attorney can't help you at all because the FAA has not committed any criminal acts. You need an aviation attorney and potentially a medical advocacy group or a dedicated AME for tougher cases. If you the FAA has truly denied you without just cause, you can always appeal to the NTSB, Administrative Law Justice, and through the appellate courts that eventually lead to the Supreme Court of the United States (if they choose to hear your case, though statistically there is less than a 1% chance of that occurring). You're going to need a dedicated and zealous aviation attorney to guide you through this confusing mess or perhaps help you avoid this entirely by convincing the FAA to be more reasonable and open-minded. If you're serious about gaining a medical after years of denial, I would strongly encourage you to meet with an aviation attorney and be on your best behavior as that person needs to become your best friend over the next few months in order for you to have a reasonable chance of success.

Best of luck!!!

Criminal Attorneys don't prosecute crimes, that's for the District/States/US attorneys (commonly known as prosecutors). Criminal attorneys deal with defendents and those who might become defendents.

When I was a kid, I thought that "criminal attorney" meant an attorney who was a criminal.

I can clearly show and prove that the FSDO violated 18 US code 241 and 242. also also, I can show where they violated 18 USC sections 1001; 3571. My aviation attorneys ignore this and side with the FAA in my case. My AOPA attorney did not know about basic med and agreed with opposing attorneys that I lost my MEDICAL when FSDO gave known false information to the Flight surgeon.
My need for a criminal lawyers is for them to help me with the process of getting this in front of A federal court.

You do understand that you, as an individual, have no right to prosecute anything? Criminal law is not a victim-versus-defendant situation. It is society as a whole that is harmed by the criminal's action and it is the state (literally a US state or the US itself) that brings the action on the public's behalf.

Even if someone in the FAA committed a crime and got prosecuted for it, it wouldn't mean anything for your medical.

There are two major reasons attorney's won't take your side: You can't pay them -or- you're wrong and there's no way they can carry forward such a proceeding.

You’re right I cannot complain as an individual in crime related cases however, I can go to the NTSB and dispute the FSDO denial of my second class MEDICAL. Thank you FrequentPilot. I will continue to fly under basic med.

Both what? A Basic Med and a X Class Medical? Why?

There's no saving grace by having both. If you're saying get the Basic now so that when you loose your X Class you're still covered, I don't think so. You can't have a Basic Med if you "loose" your other medical. I don't think there's a free pass because you have the Basic Med in your pocket. And I don't have a Basic Med, but I thought there was a question when you go to get one OR renew if you've every lost your medical?

If you’re a pilot and you have your medical deferred for a reason other than the four disqualifiers for basic med, you can fly under basic mid until you clear up the deferral. If the FAA denies your medical for false reasons, they are committing a crime.

Umm... Sorry, but is there a lot more to this story than your medical?

The "FSDO" has absolutely NO jurisdiction over medicals. The FAA's Office of Aerospace Medicine is the top dog. Under them if there is a reason for follow-up tests or a denial of a medical, it would fall somewhere under the Federal Air Surgeon, Regional Flight Surgeons or started by your AME (that already knows through their training they can't send your medical through without the tests).

I'm not an Attorney, but... As for an AOPA Attorney not knowing about Basic Med, especially since AOPA is trying to push it through in Canada and IACO, does not sound plausible. So what's the rest of the story if the FSDO was indeed involved, maybe that led to the FAA looking at your medical?

I also believe you said you were currently flying with a Basic Med. So did you ultimately get a 3rd Class or a Special Issuance? You cannot have a Basic Med if your 2nd Class was denied, per what you said earlier. That denial needs to be resolved before you can move on to use a Basic Med.

you can fly under basic mid until you clear up the deferral.
Maybe someone else here can confirm or deny... But I think you have to have a valid Medical to then get a Basic Med. So, from what I've heard in FAA seminars and read, until your deferral is cleared up you cannot be issues a Basic Med. So you may want to look into that before the FAA uses it as one item on the naughty list. :D Now if you can go to an AME and just get a 3rd Class, then you're golden to continue with the Basic.

Actually, if you have a disqualifying condition and the FAA has not explicitly denied you yet, you're free to fly basic med. All you need do is have the sign off from your basic med doctor and self assess that you are OK to fly. Specifically, if you are in a deferral situation with the FAA, basic med still works until they flat out tell you denied.

Note this is quaintly different than the sport pilot "drivers license medical" rule which says that your most recent application must have been issued.

The FSDO does not issue or deny medicals, though they can certainly make a report to CAMI if they feel you don't meet the requirement. You're free to appeal to the FAA first, then the NTSB, and then try your hand in district court, but it would take a lot of evidence not apparent here to suggest you'd win at any of those levels.

Or...... "Criminal Attorney" is just being repeating yourself.

But I think you have to have a valid Medical to then get a Basic Med.
You must have or have had at least one medical active after July 2006 to qualify, and your last medical was not denied, revoked or suspended. You don't have to have a current medical. Your medical could have lapsed 20 years ago and you can still get Basic Med.

To the OP - keep looking for "Doctors in a Box" that do CDL's. You'll find one that does Basic Med. And yes, I've run into several AME's who won't do Basic Med, so I think that is not fertile ground for you.

But they did! They colluded with an airport manager, and now I cannot fly into that airport as a pilot or a passenger on a general aviation airplane. I can be a Pilot into any airport in the United States, except one. I can be a passenger into any airport in the world, except one. And they attempted to keep me from flying anything, anywhere. I look forward to having AOPA represent me in front of an NTSB Administrative Judge. I have 50 years of paying Pilot Protection with AOPA. let’s see if that helps.

So …. Basically you can’t fly into one specific airport. What transpired that got a person banned from an airport? Dan G activity?

Conspiracy to deny someone’s rights.FSDO and airport management defraud a court to agree.

You can't appeal a denial to the FSDO. The only way the FSDO can help you obtain a medical is via a SODA. I'm sure the FSDO can request that the FAA examine your records and even deny you, but if that's truly the case, I would strongly encourage not to engage in any form of communication with them, especially without an aviation attorney.

You can only appeal a medical denial to the Federal Air Surgeon, NTSB, Administrative Law Justice, and appellate courts. As I mentioned previously, my recommendation is to find a good attorney and start this process because this could take years. I'll also add this, if you truly believe that an injustice occurred, you should be extremely motivated to get this in front of a judge. In theory, this should prevent future injustices from taking place (though in practice, it almost never does since the FAA is never actually punished) and hopefully discourage the FAA from taking any additional punitive action against you.

Lastly, I believe your basic med is invalidated after a denial even if the denial occurred due to a condition that is not one of the 15 conditions that is specifically disqualifying in the regs. If that wasn't the case, that would defeat the whole purpose of basic med. You can fly with an expired medical, but once the FAA denies you, that's the FAA's way of saying, "you can no longer fly by yourself in any capacity, PERIOD!".

In conclusion, find a good attorney who you get along with and good luck! I hope to see you in the sky soon!!

Criminal Attorneys don't prosecute crimes, that's for the District/States/US attorneys (commonly known as prosecutors). Criminal attorneys deal with defendents and those who might become defendents.
Sorry, that's exactly what I meant. I meant to say that "no prosecutor (in this case a federal prosecutor because the FAA is a federal organization) or criminal attorney can be involved in this case or any of the parties involved in it because no crime has been committed. Meaning, any criminal attorney would be legally obligated to send the individual I was replying to on his way because that individual has not been accused of, investigated for, or charged with any criminal offenses (to my knowledge anyway)."

You must have or have had at least one medical active after July 2006 to qualify, and your last medical was not denied, revoked or suspended.
But the question was about "deferred" medicals. I *think* you need a current medical, so that is the question. Can you get a Basic Med if you have a deferred medical? What I think, but do not know, is not considered a current/active medical.

And I'm not the one looking for a Basic Med.

But they did! They colluded with an airport manager,
Sorry dude, you've just gone into the BS mode.

FSDO does not have anything to do with medicals.
Airport Managers do not have anthing to do with medicals or anyones employment.

So what did you really do?
