Public display of the consumption of alcohol

    I am not sure that is 100% true. He said it is not motor vehicle related, so it is not immediately reportable, but it is a misdemeaner alcohol related conviction, so it would need to be reported on the next medical. He did indicate it shouldn't be a problem, unless there is DUI and then it would be treated as a history of possible addiction. I don't think it is fair to say it is not reportable, because that doesn't seem to be supported by the facts.

    I looked them up before - they do allow it but the Yelp/etc reviews scared me off. Pretty consistent over the years. Plus its on the far side of Dallas. Not terribly far but I would prefer closer.

    He said it was not reportable on 61.15.

    If it rises to the level of a misdemeanor conviction, technically you have to report it under 18w. However, by itself it's not going to raise much interest in the AME other than to satisfy his own curiosity.

    Objection: Officer has not been certified as an expert in chemistry. Cannot testify as to what was present in the container.

    [Assuming you did not admit to possession alcohol - this is AFTER we determine there was reasonable suspicion to detain you - and then you did not stand on your fifth amendment rights resisting search and refusing to cooperate = of course you didn't because no one ever does]

    Move to dismiss - lack of evidence.

    Right, that is if he sticks around Texas to fight it (he is from California). He said he was just going to mail in the fine. Isn't that the same as admitting guilt? It is definitely a class C misdemeanor. It does have to be a conviction for 18W, so he could fight it.

    Sadly one two many Texans have used their 'freedom' to fill our nice rivers with thousands of empty beer cans, six pack cartons, and vomit. The people living on the tubing rivers got sick always have to clean this s**t up and in many counties enacted the ban in question.

    I've been a lifelong resident of Texas and didn't know it was against the law to drink in a public place IN A STATE PARK... But now I do.

    And for the record, it is a class C misdemeanor.

    Someone please catch me up, is this about public display of consumption of alcohol or public display that one has consumed alcohol? A paper bag will help the first scenario. I haven't figured out how to hide the second one yet.

    Lol we had to drive one day from MGM to Selma airport for a site survey for comm equipment set up. I asked one of the AL ANG guys how long it'd take. He answered, oh 4-5 beers I guess. About an hours drive, so he was right. :D

    My primary instructor and I used to share a townhouse. We'd go out drinking and would have to stop at his brother-in-law's liquor store (at the end of our street) to get a six pack to drink on the way. We couldn't possibly waste the twenty minutes on the drive between BJC and Boulder not drinking.

    Of course, he also would drive home with his IFR hood on. He said it helped him concentrate on the lines. I'm always surprised I survived that phase of my life.

    Legally you were cited for a Class-C Misdemeanor in Texas, the lightest form. Once you pay the fine, you are admitting guilt and this amounts to a non-motor vehicle conviction under 18w. Report it at your next medical, make a statement of the facts. I don't think the FAA is that concerned about the fact that you were holding an open container while camping, especially when done in ignorance. You aren't going to get a deferral over this.

    I've lived my whole life in Texas. Texas is a hard state to paint in the broad strokes you're using. The state is so large that you'll find many different accents and you can easily identify the region people live in after a short conversation. I've found everything from religion to politics can vary greatly from Midland to Tyler, and from Amarillo to Houston. And I'm not talking about minor differences. It was a major culture shock from me to move from the Amarillo area to Houston.

    Now,when I go back to visit my Dad in the Texas panhandle from my home in Austin, I find myself shocked at how much it feels like people living in the stone ages. Then I remember that's where I was raised and I felt the other way when first left that area, and I shut up!
