Dr Bruce implied no in the other exact thread by the OP, and said it is NOT reportable.
I am not sure that is 100% true. He said it is not motor vehicle related, so it is not immediately reportable, but it is a misdemeaner alcohol related conviction, so it would need to be reported on the next medical. He did indicate it shouldn't be a problem, unless there is DUI and then it would be treated as a history of possible addiction. I don't think it is fair to say it is not reportable, because that doesn't seem to be supported by the facts.

Okay. Thought I was relating what he said. May have paraphrased in error.

Dr. Bruce's language can be cryptic at times.
Was your DL suspended, and did you go to a Driver's education course?
This should not be an issue and is not subject to vote. Howver, if you subsequently do a REAL DUI, this will become the "second data point" toward "FAA defined abuse behavior" when the situation is examined (future), subject to "reporting requirements"

I recently reclaimed possession of a Mosin Nagant and some surplus 7.62x54r ammo my dad bought for me years ago.(1938 Tula round receiver)

I thought that, it being Texas and all, that I could find a range that would let me shoot to my heart's content. Unfortunately, the ammo is classified as FMJ and steel case. Which almost every range in a 40 mile radius doesn't allow FMJ, both indoor and out. One range lets you use it on the 100 yd range but only sitting down, and it is not allowed on the 150 yd range AND you have to have a 3x optic or more to shoot there too.

The cheapest non-FMJ steel case 7.62x54r I can find is 17 bucks for 20 rounds  The 440rd spam can I have was maybe 200-300.
Have you tried Gibson's?

I believe there are two threads by the OP here... one of which Dr Brruce said not reportable.

Just sayin'....

Yeah but that Dr Bruce guy can kill a thread full of conjecture, speculation and misconceptions with a quick dose of knowledge and facts. Thats why we're all on this thread instead. He kills threads faster than Texas kills inmates. Bastard.

He said it was not reportable on 61.15.

If it rises to the level of a misdemeanor conviction, technically you have to report it under 18w. However, by itself it's not going to raise much interest in the AME other than to satisfy his own curiosity.

Not Guilty.

Trial

Officer says: "I detected the possession of alcohol . . "

Objection: Officer has not been certified as an expert in chemistry. Cannot testify as to what was present in the container.

[Assuming you did not admit to possession alcohol - this is AFTER we determine there was reasonable suspicion to detain you - and then you did not stand on your fifth amendment rights resisting search and refusing to cooperate = of course you didn't because no one ever does]

Move to dismiss - lack of evidence.

Now - as to the Medical Reporting - what does the form say?

Right, that is if he sticks around Texas to fight it (he is from California). He said he was just going to mail in the fine. Isn't that the same as admitting guilt? It is definitely a class C misdemeanor. It does have to be a conviction for 18W, so he could fight it.

I'm surprised; I thought Texas was supposed to be some kind of bastion of freedom.

Sadly one two many Texans have used their 'freedom' to fill our nice rivers with thousands of empty beer cans, six pack cartons, and vomit. The people living on the tubing rivers got sick always have to clean this s**t up and in many counties enacted the ban in question.

Unless it was a local ordinance, it most certainly was a misdemeanor. All of the Texas state alcohol violations are at least class C misdemeanors.

It was a class A citation. Not sure if that changes anything . Let me know

Hi All,

So I was just given a "citation A" ticket for having a beer on the river during the 4th of July weekend at a Texas state park. I am originally from California and there you are allowed to consume alcohol at a state park. Apparently in Texas you need to be in your tent, or RV. Anyways, I was obviously not in, a motorized vechile and was just minding my own business until the officer wrote me up. I don't have to go to court at all, I just have to pay a fine and be done with it . Under 14 CFR 61.15 do I have to report this to the FAA ? Any response would be greatly appreciated, thanks!

It was on Sunday before noon wasn't it?

Edit to add....

I've been a lifelong resident of Texas and didn't know it was against the law to drink in a public place IN A STATE PARK... But now I do.

And for the record, it is a class C misdemeanor.
TITLE 31 NATURAL RESOURCES AND CONSERVATION
PART 2 TEXAS PARKS AND WILDLIFE DEPARTMENT
CHAPTER 59 PARKS
SUBCHAPTER F STATE PARK OPERATIONAL RULES
RULE §59.136 Penalties
Penalties for violations of §§59.132-59.134 of this title (relating to General Rules, Closing Hours and Overnight Use, and Rules of Conduct) are Class C Misdemeanors, Parks and Wildlife Code, Chapter 13.112.

Source Note: The provisions of this §59.136 adopted to be effective September 9, 1996, 21 TexReg 8307.

It seems to me, if he pays the fine, he is pleading guilty and this would count as an alcohol related arrest/conviction. If it is not a misdemeanor or a felony, what is it? In this case it is a misdemeanor:

I received a Class A citation, not sure if that changes anything let me know. Would this go on my permit record ?

Once upon a time you could drink in Federal parks, like the area around the Tidal Basin. (Once upon a time there were no crowds like there are today).

Another privilege spoiled.

Read the small print on the ticket.

'To avoid jail time, move your ass back to California.'

Please comply and take as many of your fellow Californians with you.

Just get a local "ticket lawyer" to plea bargain it to something less than a misdemeanor, problem solved.

Someone please catch me up, is this about public display of consumption of alcohol or public display that one has consumed alcohol? A paper bag will help the first scenario. I haven't figured out how to hide the second one yet.

Seriously. It's the revenue that states cares about, not the specific title of the offense.

I remember when distances in Texas were measured in six-packs. Pearl Beer six-packs.

Lol we had to drive one day from MGM to Selma airport for a site survey for comm equipment set up. I asked one of the AL ANG guys how long it'd take. He answered, oh 4-5 beers I guess. About an hours drive, so he was right. :D

My primary instructor and I used to share a townhouse. We'd go out drinking and would have to stop at his brother-in-law's liquor store (at the end of our street) to get a six pack to drink on the way. We couldn't possibly waste the twenty minutes on the drive between BJC and Boulder not drinking.

Of course, he also would drive home with his IFR hood on. He said it helped him concentrate on the lines. I'm always surprised I survived that phase of my life.

Legally you were cited for a Class-C Misdemeanor in Texas, the lightest form. Once you pay the fine, you are admitting guilt and this amounts to a non-motor vehicle conviction under 18w. Report it at your next medical, make a statement of the facts. I don't think the FAA is that concerned about the fact that you were holding an open container while camping, especially when done in ignorance. You aren't going to get a deferral over this.

Haven't spent much time in Texas, have you? Any further discussion or comment from me about Texas politics, freedoms, etc will get me banned. Family from there, I spent 11 years there, happy to have left. Next time I go back, will be to be buried in the family plot.
I've lived my whole life in Texas. Texas is a hard state to paint in the broad strokes you're using. The state is so large that you'll find many different accents and you can easily identify the region people live in after a short conversation. I've found everything from religion to politics can vary greatly from Midland to Tyler, and from Amarillo to Houston. And I'm not talking about minor differences. It was a major culture shock from me to move from the Amarillo area to Houston.

Now,when I go back to visit my Dad in the Texas panhandle from my home in Austin, I find myself shocked at how much it feels like people living in the stone ages. Then I remember that's where I was raised and I felt the other way when first left that area, and I shut up!

Hey Jack, when you go back home to the panhandle do they say "you ain't 'round from heah are ya boy"? :D

If I got a ticket in Texas and lived in California I'd forget it happened. If they came after me for the money I'd tell them to pound sand.

Problem is, they most likely would suspend your California driver's license....

Did California ever sign the agreement on that? I thought they were one of the five...
