Where? The few times I've been laid off there was no notice. I even found out once that I was going to be let go because they mistakenly direct deposited my last check. I worked one place where people figured out they were being let go because their computer accounts had already been deleted when they showed up for work.

WARN laws are relatively new, and only apply to certain sizes of layoffs. Companies play all sorts of games not to have to issue the warning.

Well, where I'm at. :) Should have said, "Most large companies."

The Worker Adjustment and Retraining Notification Act requires companies with 100 or more employees to provide 60-day notifications of mass layoffs or plant closings. Again, it DOESN'T apply to contractors, so the 60-day notice doesn't apply.

Had a buddy go through the WARN cycle a number of times a year or so ago; he'd get his 60-day notice, and his boss would right it and get it rescinded at the last moment. Then he'd get ANOTHER 60-day notice, etc.

Lets say we pay her 107 which is $214,000 annual expense to our company. And I mean EXPENSE. We aren't capitalizing on this batshidttery in any way.

Let's say she converted at 90-120k. Would benefits (vacation, 401(k), Medical, potential severance) outweigh the cut her employer gets?

Well, until DoL or the tax man determines that she meets the standard for "employee" rather than "contractor"....
 
How do these sort of people even get hired? Is she good at her job? Does she benefit the company in any way?

People do business with folks they like. It seems possible that your company could lose business if she, as a contractor, just annoyed the heck out of a prospective

Where I worked, you were called into an office, then someone walked back to your desk with you so you could pick up personal things and then escorted you to the door.

Where I work, we had a big spike in layoffs over the past couple of years. Folks would get 60-day WARN notices. They, and often their bosses, would scramble to find other work in the company. Sometimes it worked out, sometimes it meant an additional ~150 miles per day in the commute.

Some didn't take other jobs, and would get laid off when the WARN notice expired. They'd then get six month's pay as severance. Most of my buddies who got laid off were old enough to retire, so they took the ~$80,000-$100,000 severance, and put in their retirement papers a few months later. The company pension plan is pretty good.

They all seem to send me pictures...usually at the helms of their boats....

Ah. When I was laid off it was at a small company.
