Child Support nightmare from hell.

Did the 8900 come as from a disability benefit for her from your policy? As in even if you were still married to her mother she would have received that funding?

This is what happens when minor child has a parent who becomes disabled. After the parent becomes disabled the minor child will then start receiving funds because this parent is now disabled. I am not sure if this happens if the parent who becomes disabled lives at home with the family. But this is what happens when they do not.
 
The state can not take from the disabled parents ss to pay the child then sue the parent for the same amount. Its called double dipping.
 
No way Jim. I have been through hell. I tried to contact Paul laird. Lets see if he gets back with me. I am fighting this if it takes another 10 years.
 
I know it seems like people don't care but I truly wish you luck tony. I would call The division of child support enforcement and go right to the source. One day at a time and you can get stuff done :wink2:

I may not have made myself clear. I believe your first priority should be to do what it takes to make both you and the child support folks happy with the situation from now and going forward. That will require a positive effort from you to resolve things.

I further believe the subject has beaten to death in this venue, and no further constructive thoughts are available.

That said, if you wanna sue somebody, knock yourself out.... it's no fun, as you know.

They transferred me for one department to the next to the next. This was how I ended up at the states attorney's office. They transferred me there.

No one wants to do anything. I am told go back in front of the judge. Not by my self I am not no way.

You can't do this over the phone with bureaucrats. Call all of the resources we've posted, get a damned attorney and have him deal with it. PoA isn't going to fix this for you.
 
As this is a public forum, I'd recommend you NOT post personally identifiable information here, like name, address, ssn, etc. if you think dealing with the government is a pain, battling identity theft is no picnic.
 
I agree, I wouldn't post any more papers and you have nothing to prove to us. You need to fix this and only you can do it. Fix the problem first, then worry about getting compensation.
 
I never spoke with anyone on the phone. I have never heard of such a thing. The courts do nothing over the phone.

But like I said. Disability was paying my child from 2002 until 2005. But she did not receive this until around 2009 or so. No one counted that 8900 bucks. You can not double dip.

It's not double dipping. That money does not come from your money, it's paid to minors for their parent being disabled. It is not counted as child support and is not considered child support. Part of paying into SS is your minors have this insurance money. Forget about her getting it, it does not effect your monthly benefit or her child support.

Even so I was not behind. I am going to hire an attorney. I will take all the info here and use it. There has been some very good advice as to where to look for help. As soon as I am able I will do this.

Thank you so very much. I will go into this office the very first thing Monday Morning.

I have the divorce decree, I also have the judges order closing this case. Along with the 13 months of over payments receipts. I also have paper work showing the case was reopened.

The state needs to pay for what they have put my wife and I through because of this child support and pay big time. They put us through hell.
Did you call Legal Aid?

At this point, you have convinced me that there is nothing anyone can do to help you. You are doomed to pay child support forever. I've followed this from the beginning, and I do not know what to say. Every bit of advise that has been given you has been no good, you do not seem to be able to do anything yourself, except complain, and I do not see it resolving itself. Plus, you posted all your personal information on the internet for anyone to steal, which leads me to believe that you do not make good choices. Sorry, I do not intend to be harsh, but there is no other conclusion that I can see. I hope that some day, some good comes into your life.

Apparently they DO this sort of thing, but on a "as resources permit" basis.

It was put back until tomorrow. They are on the ball in that office. She wanted to meet today but it just can not happen for me. It has to be tomorrow.

I knew to post here. I would be running all over town asking every attorney I could for help. I thought why not step back and ask for some help. I have no problem asking for help.

Thanks again to all who has helped. Moving forward and not backward or sideways feels good.

Going to have a consultation Tomorrow with Leving law offices or Wednesday the 20th of Jan. They deal with fathers rights. Its costing 125 bucks just to talk on the phone with these people. They are located almost 300 miles from me in Chicago. Not sure how many trips an attorney will want to make for court when court is 300 miles away. But at least these people will talk to me. More then others have done.

I did go to the court house records department and got the judges signed forum saying my child support had ended and I met my obligation in child support back in 2005. I made the Judge write this out. I wanted him to put paid in full but he wrote it out this way. he was not happy I insisted on having him write this out like this. He gave me a hard time about it. But I stood firm. I wanted it signed paid in full. I was happy with what he signed even if paid in full was worded obligation met.

The lady at the records office could not believe after 10 years I was back in her office. She helped me years ago. She gave all my paper work the governments seal and charged me nothing for doing it. She handed me my papers and said, I am not charging you anything for these. How nice of her. She looked at my papers and said my child support ended in 2005. She could not believe ten years later I am still paying child support.

The Attorney said something very shady is going on here. I have to agree. Not sure if they will take the case. They must take my case on a contingency plan. She said they do not do this. She must speak to the head man. I offered 25% after attorney fee's of any award to go back to the fathers rights group.

I find out tomorrow if they will help me.

Find a young and upcoming law firm to take the case.. Most would kill to get positive exposure and free advertisement for winning a slam dunk case against the guvmint....

One of the great thing about living in the county seat is there are lots of hungry lawyers within a couple blocks of the courthouse. There was even a guy going door to door this summer in my neighborhood, dropping off his business card and flyer.

I told her I forgot about that and that I raised yeck when that happened. But no one would listen. It was my dad's support to be paid to my mother. The state tacked that onto my child support. Its a long story how this happened and why but it did indeed happen. No one would listen when I told them this was happening. She saw this. She could not believe this either. It sounds like science fiction but I am living it. She said something very shady is going on here. I hope they take this case. But if they don't I am not giving up. I am fighting this with all I have.

I went into child support enforcement and spoke with a case worker.



He takes my paper work that has my case number. He looks it up. His name was Erin.



Erin: You owe us a lot of money and we have not received one penny from you in over 15 years and you are in big trouble.

Me: Really then why did I receive these over payment checks

Erin: You cashed these checks. Buddy you are in really big trouble and could be going to jail.

Me: Really then why do I have this paper work form 2010 telling me I only owe 48 bucks

Erin: let me see that paper work

Me:I hand it to him

Erin: Oh well I see here you had a zero balance in 2002, and in 2005. But today it shows you owe us thousands. I have no idea why.

Me: What about this $20,838.38 that I was charged two months after I file for divorce and before my divorce is finalized.

Erin: Can I get your phone number and give this case to someone who may be able to help. I want you to get this straightened out for I see you have been over charged a lot of money. But tomorrow is my last day.

Me: Oh great, I will be waiting for your call, and thanks for your help.

Erin: I will call you by 5 pm no matter what I find.



A couple hrs goes by and I get a call



Erin: Harold we found that indeed you did have a zero balance back in 2002-2005. We did not do this it was done by the courts. We sent a letter to Social Security to stop these checks. You may be charged this month for it's to late in the month to stop this, If that happens we will send you a check. We are very sorry.

Me: What about the 20 grand I was charged.

Erin: You have no balance, it's a zero balance.

Me: I know I have a zero balance, but if you look I should never had been charged this 20 grand two months after I filled for my divorce.

Erin: What happens when you do not pay your support your x can call and have us go after the balance. This is what happened here.

Me: Let em tell you what I think happened here. Harold A. Sweet Divorced my mom. He never paid his child support and was 20 grand behind. This was my parents Harold was my father.

Erin: Well hell, this just gets better. I will call you.



30 mins later I get a call and this time it's some woman. I looked and could not find a pin to right down her name. i was so involved in the conversation I could not find a pin and can not remember her name. So I will call this woman case worker in this conversation.



Caseworker: We have sent a letter to SS to have this stopped. We had to open up a dummy account to have this done for your case with us is closed. She then started talking in circles. I could not make heads or tails from it. She kept saying, we here at child support enforcement did not do this.

Me:No but you enforced the order.

Caseworker: well its being stopped now.

Me: what about the 20 grand I was charged.

Caseworker: You have a zero balance you owe us nothing.

Me: I know this but I was forced to pay 20 grand that was my dads debt.

Caseworker: We know nothing about this, we did not do this it was done by the courts. I am here to get this to stop and nothing more, I did my job and am done with this. We did not cause this. Good bye.



She hung up. I call the attorney and tell her what happened. I told her I want a grand total of what I have over paid over these 16 years including the 20 grand. I also want someone to pay for the hell the state has put me through.

She said she was drafting up a letter to have this support stopped, she will stop everything she is doing and wants me to bring that letter in when I get it. I told her I would drive it right over to her when I get it. She said we will go from there after we see that letter. For she doubts the state or case worker will state that I did indeed have a zero balance as of 2002. She said we will see.

I said I careless what this letter says and i want someone to pay for the hell I have been through. I owed none of this and for twenty years the state has made my life hell. She said she will see what see can do.

I received a forum showing they stopped my support. No reason as to why or what they plan on doing about the tens of thousands I have over paid. They wanted to throw me in jail for cashing those checks but do nothing to my X for excepting monies that she knows was not owed to her and doing it for over 11 years.

My day in court is coming.

Another situation that reminds me that I have nothing to complain about. I seem to be coming across a lot of them lately. Good luck taking care of this issue.
