NA Cell Phone Location - No expectation of privacy NA

”When a cell phone user transmits a signal to a cell tower for his call to be connected, he thereby assumes the risk that the cell phone provider will create its own internal record of which of the company’s towers handles the call. Thus, it makes no difference if some users have never thought about how their cell phones work; a cell phone user can have no expectation of privacy in cell-site information.”

I haven't checked recently, but as of about a year ago, there was a split authority between different Federal Circuits. I think a Fifth Circuit (Texas) court held that no search warrant was needed to obtain the information, where a First Circuit (Mass) court held that a warrant was required.

You're talking on a radio when using a cell phone. You can expect privacy how? Encrypt or forget it.

Well there used to be no expectation of privacy when using the radio, but hten the industry twisted the arms of government back in the 80's and passed the ECPA. This makes it illegal to intercept and listed and CREATES an expectation of privacy specifically with phone conversations be it landline or wireless.

Note the EPCA only covers the content of the call. As with before the information on the numbers called (and now the location) are less protected.

The real truth is you don't even need to talk. You are carrying a beaconing GPS system that makes ADS-B look tame.
