I would be sooooo pizzed! Just wow. Re the Galveston plumber.

Verbal is binding in many states. No luck needed.

What's the old saying, it's not what you know, it's what you can prove.

"Mr. Dealer, did you tell the plaintiff you would remove his company logos from the truck"

"No your honor"

"Mr Dumbass, do you have anything in writing, any proof at all, that you can show me that the dealer promised to spend hours and hours pealing off your company logo from that old truck"

"Uhhhhhh"

Done.

Yes it is but if it is one person's word against another person's word without any corroboration, it will default to the written contract and if there is no verbiage in the written contract about it then SOL.

It will be what the jury decides.

Fortunately they are allowed a jury who will put themselves in the plumber's place way more likely than the dealer's.

But if he started to take them off, told that would be taken care of, and there's evidence they were partially removed, that's good enough for me if I'm in the box or wearing a robe.

Mr Dealer, do you have any proof you did not tell him that/specifically tell him they would not be removed?

Goes both ways.

I find it interesting that it's more profitable to ship a truck half way around the world vs selling it locally.

It was sold locally at auction, then probably changed hands a time or two and ended up being exported.

Let me tell you, as a dealer, I will do anything that is in anyway reasonable to NOT be in court. It is a no win for a dealer at best you lose days of work and a lot of attorney fees at worst, you lose the case as well. :mad2:
I had a guy take me to magistrate court accusing me of stealing the transmission out of his 1999 Mercury Mystique! It took two days including half a day to find out it was rescheduled. The guy was a loony tune, but the judge, whom I know personally, said, "I see how it could have happened, but I am just not convinced it did happen." She was actually thinking a new car dealership would steal and swap a transmission in a $800 car. :mad2:

Well, in all fairness, the 1999 Mystique had a much sought after transmission.

Why did you steal that poor old man's transmission? Plenty of them in the junkyard.:dunno::rofl:

Seriously though, would you have sent the truck off the lot with the signage on it? When I was a kid it would have been pulled around the side and the first thing I would have done was removed them and buffed it out.

I'm sure the plaintiff will go in-country to repossess the vehicle to present to court as evidence. right...?:yesnod:

What a publicity stunt.....

This plumber is getting millions in free press....

If he can't get more business now... he is surely a loser... IMHO...
Yea, he should have paid the dealer extra to leave them on.
