Hello,

I am currently trying to a copy of my medical records from a HIMS AME, however they are refusing to send them to me. Is the HIMS AME as a physician not required by law to provide me a copy of my full medical records from his practice? They have instead told me to request my records from the FAA.

As an old retired AME(25yrs), I suspect he is right. Those records belong not to you, but to the FAA, and you need their permission to get them released. Now if he was your own physician, it would be different.

The “I’m an AME I don’t owe you duty of care” argument just failed a motion to dismiss… time will tell.

What makes you think there are records. On a normal visit, it's all done on the FAA's computer. If you have submissions, your AME might have made a copy but the originals went to the FAA.
As Bruce says, what really matters is what the FAA has on file for you. It takes a while to get, but it is straightforward.

If I go to a physician for a pre employment physical, his duty is not to be my physician, but to evaluate me thoroughly for the company for which he is doing the physical. This is despite who is paying him.

CLIA says you are entitled to the results of that exam… despite what they will tell ya.

And I’m pretty sure they are still required to abide by state license requirements and ethics.

Easy to circumvent this, just don’t require a MD

What records are you trying to get copies of?

Cite?

Not challenging you. I’d like to read it.
What do you want me to cite? They treat people or have a duty of care when they do?

AI, “
Yes, a HIMS AME (Human Intervention Motivational Study Aviation Medical Examiner) acts as a
lead and coordinator for a multi-disciplinary team, or "crew," when treating pilots, including specialists like HIMS psychiatrists, neuropsychologists, peer pilots, and airline management, all working to help the pilot recover and regain FAA medical certification. The AME manages the pilot's progress, conducts tests, submits reports to the FAA, and ensures the pilot meets all recovery milestones.“.

“Yes, a HIMS (Human Intervention and Motivation Study) Aviation Medical Examiner (AME) has a significant duty of care, acting as a lead in a pilot's recovery team to ensure their fitness for duty, focusing on substance abuse/dependence and mental health, balancing pilot support with public safety by rigorously monitoring treatment and compliance to protect aviation safety,
according to sources like examineair.com, the FAA, and flight-med.com https://examineair.com/the-role-of-hims-ame-evaluations-in-pilot-recovery/, https://www.faa.gov/ame_guide/abuse_dep,. They are specially trained to manage complex cases, overseeing treatment plans and reporting to the FAA to help pilots return to flying safely.”

:D

I don’t want you to cite anything. I asked @Tools to “cite” (point me to) the case he mentioned so I could read the legal arguments that were made by both sides at this preliminary stage.
