Emotional Support Animal and FAA Class 3

It’s not cool at all to lie about emotional support needs because I make it more difficult to gain all the necessary papers for people who actually need it.

As someone that's dealt in multi-family housing, I've dealt first-hand with fraudulent ESA claims.

I've also seen ESA circle-back with unintended consequences for the person who simply wanted their dog/cat in a no-pets environment. (restaurant, no-pets-apartment, whatever...)

When an ESA Fraud gets unintended consequences for his/her actions, I find myself HIGHLY amused.

Anyone can make their pet into a ESA there isn't any state regulation on it my aunt has her dog registered as a ESA some online website. If a doctor hasn't diagnosed why does that even have to be mentioned on any FAA forms? Lets say you have 2 dogs one dies and you feel sad and want to make the other dog a ESA because makes you feel better to have the other dog with you all the time why is the FAA concerned about that??

Feeling sad is now considered a diagnosed medical condition has to be reported. This is completely ridiculous that it's even being considered.
 
But then during the lockdowns the liquor stores were deemed to be essential as folks needed help with their emotional support via Doctor Captain Morgan or his assistance Doctor Jim Beam.
Imagine how much MORE the suicide and domestic violence rates would have gone up.

None of the ESA websites I’ve looked at list “feeling sad” as a reason. They all use the word “disability”, or something similar. Can you provide the “feeling sad” website?

But they are not service animals. And that’s beside’s the point. Legitimate ESA’s come with a disabling diagnosis by a licensed mental health professional. For someone flying under an FAA medical, the both the diagnosis and the disability should be declared.

The Fair Housing Act also has language around ESAs that indicates a disabling diagnosis as well, so again reportable.

Where it gets squirrelly is in state and local definitions under various acts and ordinances; these may not include language around disabling conditions as a requirement. These types of ordinances/laws cater to the ‘I’m special’ crowd, honestly, since no health department wants to repeal codes around animals and grocery stores, for instance.

But if you check a box on a website that says, “I’m disabled,” it doesn’t matter what the local ordinances/laws are…you’re claiming a disability to get the certification, not “feeling sad”. Which negates @kell490 ’s argument.

The kicker is some random website registration has nothing to do with the federal definitions. Those websites and what they offer is essentially worthless.

There isn't any state laws that regulate ESA I'm not confusing anything if I want to call my dog an ESA it's completely up to me to do that. Flying on an airline they might have their own requirements has nothing to do with someone claiming their dog is a ESA. Walking into a grocery store with a dog has ESA harness on likely wouldn't be questioned. If someone went to a doctor was diagnosed with depression and also has an ESA that's a different situation the OP didn't claim that. Simply having an ESA has nothing to do with the FAA I see no reason to disclose that.

if you want to argue against someone with a couple years experience with lawyers and property owners on this specific matter and try to believe you’re correct…. Go right ahead.

No…but it’s used frequently as a bandaid that reduces or delays them.

The increase in domestic violence and suicide rates because of the use of alcohol is quite well proven. Maybe they should get an emotional support pet instead ...

It’s dangerous ground. I know of an individual that claimed ESA status for travel on the airline that employed him as a pilot. Guess who self disclosed to the FAA they had a pilot claiming ESA needs. Wanna guess who lost their job and every certificate issued?

Our word is our bond as airmen.

Some chuckle head lies about needing an ESA: the FAA will believe them and act accordingly.

Anyone considering this while holding a medical should think hard prior to claiming a need for an ESA.
 
If you need a emotional support animal, you have active disease and are grounded, e.g, not stable enough to be PIC.

Now that's not fair. Every dog is an emotional support animal.

Guidelines not laws and as I stated airlines, Property owners, and anyone else can make up their own requirements again it has nothing to do with someone who puts a harness on a dog that says its a ESA.

Are you familiar with Title III of the Americans with Disabilities Act, the Fair Housing Act, and the Air Carrier Access Act?

ESA doesn't qualify for the ADA see below that only supports my position more. As I stated there isn't any law that governs someone throwing a harness on a dog that says "Emotional Support Dog". This is why airlines started cracking down on those people requiring lot more documentation about their mental health issues.

24 USC § 5.303 Exclusion for animals that assist, support, or provide service to persons with disabilities.

The key word is disabilities. Federal law defines an ESA as an animal that does one or more of three things for a person with disabilities. That was codified in various portions across the three acts.

If someone choses to invoke ESA and federal agencies, the only context is for a person with a diagnosed disability and the FAA requires any person flying under an FAA medical authorization to declare any disabilities.
 
My take, either you have a mental issue that you need the ESA and need treatment and it is reportable. Or you are trying to scam the system to get around laws or regulations because you are so self centered that those rules don't apply it you.

Either way, I really don't want you flying airplanes.

Yes I understand the Fair Housing Act the OP isn't stating they are attempting to rent a home. They aren't trying to fly on airlines, or anything else the simple act of someone throwing a harness on a dog walking around town doesn't change anything, and doesn't require any diagnoses from a doctor. You guys are saying self diagnoses is a legitimate diagnosis ?? I would say it's a different situation if you fill out forms claim your mental illness requires you to have a ESA like airlines are doing now, or someone attempting to rent a home.

State laws doesn't require someone to get a doctor to sign off like a handicapped placard. Maybe there should be state laws at the current time there isn't.
