After one of the defendants filed a motion for summary judgment, Mr. Bernath filed this little gem of a motion:

Yes. Unlikely. Mr. Bernath is now flying an RV-12. While there is fertile ground for comments, I suggest everyone refrain as Mr. Bernath can abuse the legal system against you. He is suing dozens of forum members at thisainthell.us, as well as getting orders of protection. Saying "xxx the lawyers" is a death threat...:mad2:

What's he suing them for? their critique of his photoshop work?

Ya see.... I was just quoting a famous author...

He can sue William Shakepeare....

How can he even come close to self-certifying with his debilitating condition that requires constant pain medications, and his demonstrated inability to understand that engines need fuel?

I can't wait for the story of him getting into a game of Pokey-Chest with an actual Federal District Court judge instead of a Social Security ALJ...

Not knowing a lick about what is going on, what is the one paragraph or sentence describing this persons actions?

NTSB still hasn't issued anything but a preliminary report on his crash...you'd think that fuel starvation would be a relatively quick probable cause..."Pilot failed to properly monitor fuel levels"

On September 1, 2013, about 1800 Pacific daylight time, a Flight Design CTSW, N102HA, lost engine power, and landed short of Sisters Eagle Air Airport, Sisters, Oregon. The light sport airplane was registered to, and operated by, the pilot under the provisions of 14 Code of Federal Regulations Part 91. The sport pilot was not injured. The airplane sustained substantial damage to the firewall and lower right fuselage during the accident sequence. The cross-country personal flight initially departed Coeur d'Alene Airport - Pappy Boyington Field, Coeur d'Alene, Idaho, at an unknown time, with a planned destination of Sisters Eagle Airport. Visual meteorological conditions prevailed, and no flight plan had been filed. The pilot provided a verbal statement to a deputy of the Deschutes County Sheriff's Office following the accident. He reported departing Coeur d'Alene en route to Sacramento, California, and that he encountered strong head winds and low clouds during the flight. Subsequently, he landed at a private airstrip approximately 7 miles east of Sisters Airport to check the airplane's fuel levels. Estimating that he had sufficient fuel for approximately 30 more minutes of flight, he departed for Sisters. As he approached the airport the engine "sputtered" and then stopped producing power, and he performed a forced landing into a field. At the time of publication of this preliminary report, the pilot had not provided a verbal or written statement to the NTSB regarding the circumstances of the accident.

Based on reading some of his filings it is my opinion that he is a bad attorney. While he has a history of disciplinary actions already, I wish the legal profession had better mechanisms to rid itself of bad attorneys.

Based on the incident with the CT and his writing about it here on POA it is also my opinion that he is a bad pilot. The good news is that an RV12 has very little mass and the likelihood of him doing damage to third parties during his next accident is limited.

Expect a restraining order and libel suit in the near future.

You should read the CTSW forum where he explain how using the iPad ground speed read out is a good enough substitute for airspeed.

That is the worst jumble of nonsense I've seen in ages. I'm not even going to think about trying to understand it.

The beautiful part is that he has the page set to auto-refresh every 3 minutes so that you don't miss out on any breaking news.

there's a superb website that analyzes construction and format of webistes. been around since the Dark Ages of the early 1990's. I'll nominate this one for special topics.

webpagesthatsuck.com

They'll disqualify him...it just wouldn't be fair to make other crappy web pages have to compete against something that professionally horrendous.

I am amazed he hasn't bored a hole into the ground and burned to death yet. There's always tomorrow.

Holy cow! This guy cheats Darwin every day!

"I am a very cautious pilot. I am like Tiger Woods. I am never satisfied with my performance and always strive to improve it."

OMFG

USS Yorktown typed, "Fear not. I shall never be mentioned in a NTSB report.
I am a very cautious pilot. I am like Tiger Woods. I am never satisfied with my performance and always strive to improve it."

How many people don't realize that we are all just one screw-up *or* mechanical failure away from an NTSB report? How invulnerable are people?

I just read down a little further - he said when he does a dog rescue flight he duct tapes the dog's paws together so when it lays unrestrained on the right seat it doesn't push on anything it shouldn't. This guy has "genius" written all over him.

Be damned glad you didn't build it...because when (not if) he crashes it, you can bet that the builder will be sued.

Yeah, I'd set fire to an RV I built myself before I'd sell it to Barnath.
