Question about past misdiagnosis involving depression, ADD and Aspergers Syndrome

I have a question what would be necessary to get a 3rd class medical with some past medical issues.

In the past I have been diagnosed with Depression, ADD and been prescribed Wellbutrin. Overall I was not responsive to treatment. However the doctors responded by increasing the dosage.

Over a year ago I have had my diagnosis changed to Asperger's Syndrome and I am currently not medicated. I do not feel depressed and feel that my past "depression" was more a feeling of disconnect based on feeling different. I am high functioning and the area of effect is on social interactions and personal relationships.

The question is what is required to get my medical with Asperger's syndrome and would this diagnosis override the previous depression and ADD diagnosis?

There are plenty of Asperger's pilots. I don't think that will be a problem. Nulling out the previous diagnosis will be. You need advice from Dr. Chien and he doesn't live here any more.

You need the personal assistance of an exceptionally well qualified AME (such as Dr. Chien), you will need to follow instructions exactly, and you will need to spend a few thousand dollars on testing to prove (to the FAA's satisfaction) that all of the above diagnoses were in error.

Or, you go the sport pilot route if your Aspberger's does not prevent you from operating safely as pilot in command.

In the FAA books, Asperger's falls under the general heading of "autism spectrum disorders" (ASD) along with autistic disorder (classic autism), Rett disorder, childhood disintegrative disorder, and pervasive developmental disorder, not otherwise specified, including atypical autism. You'll want to check with a specialist AME like Dr. Bruce Chien (http://www.aeromedicaldoc.com), but I would expect a requirement for a full psychiatric evaluation before issuance.

Go ahead and ask Martha Stewart. That's precisely the law she was put away for.
And not only that, she'd done nothing illegal until she lied about the legal things she'd done. And yes, the DoJ has put pilots in jail for lying on an 8500-8 before, although the stakes were a bit higher on that situation.

I'm pretty sure Martha Steward wasn't even under oath when she lied about something that wasn't illegal. If they want you bad enough, they'll find a way.

Once you sign that medical you've committed yourself.

18 USC 1001 requires no oath whatsoever. If you lie to any federal government employee in the scope of their work, of any description about a material fact, you can be indicted and convicted under that law.

And THAT is why you keep your pie hole shut.

In some circumstances, that's good advice. However, when it comes to filling out an 8500-8, the law requires that you answer fully and to the best of your knowledge. The only alternative is not to submit the application, and that means no medical certification. Omitting requested information is not an option.

Well, yeah. I was still on the 'how to answer a Federal LEO when questioned" part of the thread.

Agreed on the medical - at the sig line it says, "I hereby certify that all statements and answers provided by me on this application form are complete and true to the best of my knowledge, and I agree that they are to be considered part of the basis for issuance of any FAA certificate to me."

Interesting person.....the doctor, graduate of Vanderbilt , who decided medicine was a drag and started studying the stock market. He also has Asperger's syndrome. He is described in detail in mike Lewis's book " The Big Short" a best seller that tells of how this doctor concluded that the real estate scam of 2004- 2006 would eventually be a disaster, sub primes, no docs, etc. the doc made himself and his clients millions. Great book by a former bond trader. Highly recommend it. ( I agree not wise to lie to the Feds.)

Does he have an FAA Medical?
