N.A Help me get my son back

Hey all,

I know posts like these are very much frowned upon here, but I am at the end of my rope. I put up a go fund me to help pay for my legal fees to get my 2 year old son back. I have been in a custody fight for him for close to 4 months now, and have spent close to $4000 on an attorney. He's been successful in getting me awarded custody of my son, but there's still a fight left. I haven't seen my son in almost 4 weeks and my ex is a flight risk. Any little bit helps. Sounds like you need a good PI to track him down and get him back, from reading your go fund me page, good luck.

We're being extra careful with cash right now since I'm not going to work every day, but we'll keep your GFM in mind down the road a bit.

We have a similar problem going on inside our family (dad has solid visitation court order but hasn't seen daughters in over a year) so we both feel for you deeply in this regard.

(Mentioned your post to Karen. She "reads" PoA vicariously through me. Some of the threads she finds quite entertaining during commercial breaks of her favorite shows since I don't pay nearly as much attention to TV as she does. Our nightly ritual is I'm reading something and she's watching and we chat about other stuff during commercials if she's watching something that's not on the DVR or streaming. Haha.)

We both find the law to pretty much be a sad joke in these domestic type things. Mom in our family's case has already been yelled at by a Judge for lying, not that it's done a lick of good. A lost year of seeing kids is still a lost year while the court fiddles and acts like it'll enforce the ruling(s). It's all a nice little fiction.

Once in a while the girls would sneak a text message to dad like little fugitives. Mom must have caught on since those also stopped. Sad.
 
Mom was told in court that she committed a felony not once but twice, but the only reason she wasn't in jail is because the family court couldn't put her there. The judge told her that her arguments and filings were both smug and self serving and that Nevada law says I have custody. Sadly mom couldn't care less.

If dad has a "solid court order" for visitation, he should easily be able to have the order enforced by the police. I went through some of this bullsh*$ awhile back and all it does is hurt the kids and line the pockets of the attorney's.

That's part of it. The other part is mom is hiding similar to the situation that brought about the post. And mom has (inappropriately and eventually tossed by the judge) used restraining orders in the past to make dad look bad or "dangerous", so he wants nothing to do with giving any appearance of stalking or having anyone else snooping around anywhere near mom.

Hard to have cops show up to enforce visitation without a known place to go. And harder yet to search for someone who'll claim they're "scared for their life" to anyone in earshot if found.

Whole thing just sucks.
 
Mom is SOMEWHERE in socal. Her family and friends will hide her. I've been advised by counsel to do just what nate says, sit on my hands and let the courts work through it. Doing anything else damages my credibility with the judge. :(

Doesn't that just suck? In our case the family member was even counseled not to hire a PI, or search since even sending a PI anywhere near her could be twisted by an attorney into "stalking behavior". I can't say that would necessarily be the situation for all dads looking for their kids, but it's horrible.

And once the custody stuff is dealt with there's still the civil suit that will likely happen. They co-owned a very successful business and she emailed all the clients and told them the business was closing and shut two locations down without his approval or involvement. He couldn't stop it because that's what the fake restraining order was used for -- tactics to keep him away while she destroyed their company.

It'll take decades to sort it all out.

thats ****e! come to find out in all of this none of my friends/family liked her and all thought she was insane..
 
I got divorced in 1990, and from that moment I started saving money. My fiancee-turned -wife helped me document everything that occurred and we often stayed up until 3 AM typing a narrative which blossomed into 80-some pages.

My ex was certain she wouldn't lose custody in court, but when we ended up there it turned out she was wrong. I prepared for the court showdown, researched things like second hand smoke, found out the hours she kept my son out to, talked to his teacher three times a week, made records of her failure to provide needed dental work and orthodontia, paid for about ten depositions, and got myself amped up like it was a prizefight.

Men didn't win custody of third graders back in the early 90's, but that's what happened. Trying to be modest, but I kicked her lawyer's ass from here to breakfast. She was actually such a bad mom my testimony couldn't be refuted. I felt like I had a higher power on my shoulder guiding my way.

It cost a huge amount of money, about $50K, but it was worth it.

So it can be done. The odds are more in the father's favor now too. It's a hard struggle but it can be done.

Mom has stooped so low as to get my first wife to write a very slanderous affidavit about me. There's no level she won't sink to.

No, there isn't. Seems a woman can tell herself a lie 3 times and then believe it to be gospel truth.

Sorry to hear you are having so much trouble. Anyone that uses a child to try to hurt the other should be placed in isolation for life.

Update: Can't get lawyer to call me back. Have received advice to put a scheduled call on his calendar rather than cold calling the office. What say our sage legal counselors?

Unfortunately for you the scheduled call is so the lawyer can charge you the maximum for his/her time down to the exact second.

Any chance the scheduled call is so the lawyer will be available at the time you are?

OP has a BIG issue to be dealt with. Why is lawyer bashing needed or interesting on this?

Make the appointment. Do the work, which will be hard. No need to bash lawyers on this one.

I don't generally like doctors, lawyers, or cops. Until I need one! Then I'm like "mommy, that ____ did _____" (see that)

I've found that when you really need a lawyer for something other than routine paperwork and the like, it's advisable to choose one that even you can't stand.

Update - Got ahold of my lawyer and he's going to be filing a motion to compel her to return the child. Light at the end of the tunnel! Thank you to everyone who contributed!
 
Hey everyone,

First off, i'd like to thank everyone who contributed to my go fund me to fight for my son from the bottom of my heart. We had the final court date yesterday, and will be sharing custody of him 2 weeks on, 2 off until he turns 5 and starts school. It's not ideal, and will be an uphill battle to co parent him, but in the end, it's in his best interests. Again, thank you all.
