Lying on Medical

I know of a pilot that has been taking Vicodin and Xanax for many years and reports no scripts on the flight medical. There have been mental health issues as well. The FAA is aware of this , and I believe sent the pilot a request for a drug test within 48 hours which I believe would be clear, since the two drugs go out of your system relatively quickly. I believe this pilot was also requested to turn over medical records and pharmacy records. The FAA does have the pharmacy name as well as the Doctor that has been writing the scripts for the pilot.
My question is, can't the pilot just claim he has not been seeing a general doc, and there are not pharmacy records or medical records available? And the FAA just letting it go because the drug screen was negative?

Any thoughts?
