Can I be subpoenaed as a witness in a case from another state, and compelled to travel, at my own expense, to testify before a court?

Is there any remedy should this cause undue hardship to me (loss of job, loss of income, loss of status, etc.) because of the compulsion?

What about two states that both participate in the Uniform Act to Secure The Attendance of Witnesses?

I'm not sure, but I am referring to NC and NM specifically.

offer them an alternative such as an affidavit or a videoed interview?

I've been subpoenaed accross statelines. Th subpoena had a whole sectionon how to get reimbursement for travel from my home to the stateline (the part of the trip within the state was on my dime). The per-diem is something silly like 12 bucks, the travel was at GSA rate.

IANAL, but I would presume that such a subpoena would be covered under the "Full faith and credit shall be given in each state to the public acts, records, and judicial proceedings of every other state." part of Article IV.

I would simply say, "I can't afford to make the trip. If you pay my travel expenses and feed me while I am there, and pay for a dog sitter, I will be more than happy to testify." Although, I usually avoid them by never answering my door or phone, or opening my mail.

FF&C does not bear on this; but the Uniform Act may apply if you are talking about a criminal or Grand Jury proceeding (sorry, I was in civil-land).

Wow...I would have thought reading FF&C that this type of thing would be just what it was meant for...

OK, under the Uniform Act, if it's a criminal proceeding, the subpoena must be issued by the witness' home state right? So if I, in TN, receive a subpoena from a court in KY, I can safely toss it in the trash then? But if they go through the process and have a subpoena issued by a court in TN under the Act, I have to comply. Am I reading this correctly?

Nick, this is the second worst place to ask this question (the red board would rank first). Talk to an attorney. :)
