Lawuit Madness (revisited)

No, I still think the other one (with the airplane that took off with no fuel in one tank) is stupider.

Please don't derail my thread on the very important dangers of running shoes to discuss the admittedly equally dangerous CTSW model LSAs that won't fly without fuel. The public must be educated before more lives have been destroyed.

Oh great. Sticker heaven. We'll have those bright yellow stickers like in new cars warning us not to be stupid and worse, we cannot take them off because of federal safety laws.
"Caution: Kicking someone while wearing these sneakers could cause serious or fatal injuries to them. If they get up, your resulting pain may be worse."

Oh, and I was looking to see if the NTSB had done their factual or probable cause report yet, and Mr. Bernath seems to be pretty much a fraud all around:

Too funny.

I did an FOIA on a guy who was making wild claims of his military service.

It's amazing what's out there if you ask for it. Also amazing the extent people will go to about lying about something that's easily discoverable.

His habit of spouting off in his own defense seems to have caught up with him...looks like he's going to get some serious media attention at the hands of the Navy, VFW and other groups as a result of his spouting off on that thread.

Can't you use running shoes to kick the CTSW back into the air when the tank goes dry? There is no sticker that says you can't!!!!!

Well, he does have a point. The jury redefined his sneakers as a 'dangerous weapon' when he was clearly not in possession of a dangerous weapon.

My first thought was that the real purpose of the suit is to obtain a ruling that the sneakers are not, in fact, a "deadly weapon," and use it as a basis for appealing his sentence.

Or maybe he's just bored.

That is how it sounds like to me. He doesn't have to be right, but there is some jailhouse lawyer logic to it.

I hate it if juries and judges stretch the law because of their disgust with a particular defendant. Bad decisions create bad precedent that then is applied to other cases.

To steal a comment from that site. Nuttier than a bucket of squirrel ****.

again, I am Daniel A. Bernath, attorney at law, Chief Petty Officer (Hon) and my phone number is 503 367 4204. Call me up and lets discuss whatever you like. But no. You are there in the women’s underware, in front of your computer, taking a moment out from viewing your child porn to anonomous comment on a real American who has served his country in both the USN and the Dept of Homeland Security.
(by the way, I also drive a new Caddy, have a pretty wife, all my kids have graduated from college and I’m overweight, so I eat well too. and you? Frustrated with all you failures in life and attack the people who actually succeeded at everything he has attempted.) The US Navy Photography Association honored me with the title of Chief Photographers Mate in 2006. I took my head from pic and put it over both the pic of the other Chief and another barrister. I get a real kick out of people saying that the uniform is fake, the crow is fake, fake fake fake! You are a great source of amusement to me as you live in your trailer home-so close to your neighbor you can hear him take a **** and smell it afterwards. I live on a 5 acre oceanfront property so I can go to my 50 foot sailboat when the mood strikes me, or fly off on my Beech Bonanza on my private air strip).

Would live to see his Bo.

I guess my cowboy boots are weapons of mass destruction.

Assault and battery charges can be brought against people based on them using a shod foot. Dangerous or deadly is added based on the injuries sustained.
Somehow, I do not think the jury altered the definition of dangerous or deadly, nor do I think you can ask the government to order that anything that could be dangerous or deadly in a battery case be so labeled. But we've seem more idiotic things happen.

We have come to the realization that our courts and a jury of your peers do not work any longer.. The average jury has an aggregate IQ of less than 100.
A grand jury will indict a ham sandwich - famous observation that seems anchored with some fact..
We now have a jury that has defined a rubber shoe as a dangerous weapon. under the law.
I could spend thousands of words on here just reciting jury verdicts that are out of touch with reality and with society - not to mention the judges who bemusedly let those verdicts stand. But I won't.

The time has come for us to create the profession of Licensed Professional Juror to go right along with Attorney and Judge. The advantage is the verdicts of these LPJ's will be subject to review by their Professional Association and subject to lawsuit for malpractice - where juries are immune (and know it).. LPJ's shall be elected for a term not to exceed 2 years, same as a Congressman, and will have to answer to the voters to be re-elected. An LPJ will have to have a 4 year baccalaureate degree in a discipline other than law. An LPJ will be disqualified for having had a law degree or having been a member of the legal bar.
Then when the legal gun presents his plaintiff in court, drooling and in a wheelchair expecting the jury to gasp in sympathy, the LPJ's will yawn and tell the judge, "yeah, yeah. We've seen it before. Now what are the facts."

I'm not sure it's a derail.

Anyone else notice that this troll and Abby Normal are both in Portland, Oregon . . ?

There are all kinds of nut jobs out there.

Virtually every observatory with a public affairs officer (which is just about all of them) has a huge collection of war stories about nut cases convinced that NASA is covering up the secrets of the universe, and somehow forcing all the independent observatories to go along. As if you could keep an observatory quiet about a major discovery.

Finding a provable fungus or any other form of life on Mars would be a massive career boost, if it was verifiable. That seems obvious to most of us.

We know the truth and the truth is that NASA knew there was a creature and should have placarded the photo in a large bold face font.

Assault weapons you mean.

And if you wear a size 13 or larger, you'll only be able to buy those in Wyoming. No normal person needs weapons that large!

Hey I resemble that remark! Now if you want to talk about my ski boots I can understand your fear and trepidation, those suckers are huge!
