Thank you for your support regarding the General Aviation community’s concern over the Federal Air Surgeons intent to use a policy making agenda to by-pass the rulemaking process within the FAA. In particular the Federal Air Surgeons attempt to unilaterally impose a policy regarding sleep disorders and body mass index reporting for medical applicants.
I urge Administrator Huerta to endorse H.R. 3578, which would require the FAA to go through the rulemaking process before imposing any policy regarding sleep disorders. The potential impact of such a policy cannot be assessed in a capricious manner and if allowed to become a de-facto regulation could force many thousands of certificate holders to loose their medical certificates. Untold thousands of cases will flood the sleep disorder system as well as the FAA Medical Branch dealing with Special Issuances. The aviation industry is already fragile after years of economic erosion. The economic impact on the General Aviation Community as well as Commercial Aviation is incalculable. Without the infrastructure provided by General Aviation the entire US Aviation industry may fail. That such risk can be imposed by one man, without regard to science or a by demonstrated, medically validated need is unconscionable.
I have contacted my Congressional representative and asked him to embrace a call for the resignation of FAS Dr. Fredrick Tilton. Dr. Tilton has operated with reckless disregard of our industry, our nation and the certificate holders that would be affected. His disdain of science, and the importance of due process, is out of touch with our national values and the reality of the aviation industry. There is no validated threat to safety posed by sleep disorders in the general population and Dr. Tilton’s actions amount to nothing more than a personal vendetta that could bring down the industry.
Due process requires that a correlation between BMI and sleep disorders be established, in addition to its impact on the general pilot population, and then mitigation strategies be developed. At that point regulatory changes can be instituted to properly address the issue. Now is not the time to wantonly enact sweeping changes that have consequences that cannot even be measured. Thank you for addressing this situation before it has become critical.
