For those of you that are pilots, the FAA has halted the implementation of the BMI/ Sleep Disorder policy. But we really need to get rid of the Federal Air Surgeon Dr. Tilton. Please copy this email, change it how you like and send it to:

Thank you for your support regarding the General Aviation community’s concern over the Federal Air Surgeons intent to use a policy making agenda to by-pass the rulemaking process within the FAA. In particular the Federal Air Surgeons attempt to unilaterally impose a policy regarding sleep disorders and body mass index reporting for medical applicants.

I urge Administrator Huerta to endorse H.R. 3578, which would require the FAA to go through the rulemaking process before imposing any policy regarding sleep disorders. The potential impact of such a policy cannot be assessed in a capricious manner and if allowed to become a de-facto regulation could force many thousands of certificate holders to loose their medical certificates. Untold thousands of cases will flood the sleep disorder system as well as the FAA Medical Branch dealing with Special Issuances. The aviation industry is already fragile after years of economic erosion. The economic impact on the General Aviation Community as well as Commercial Aviation is incalculable. Without the infrastructure provided by General Aviation the entire US Aviation industry may fail. That such risk can be imposed by one man, without regard to science or a by demonstrated, medically validated need is unconscionable.

I have contacted my Congressional representative and asked him to embrace a call for the resignation of FAS Dr. Fredrick Tilton. Dr. Tilton has operated with reckless disregard of our industry, our nation and the certificate holders that would be affected. His disdain of science, and the importance of due process, is out of touch with our national values and the reality of the aviation industry. There is no validated threat to safety posed by sleep disorders in the general population and Dr. Tilton’s actions amount to nothing more than a personal vendetta that could bring down the industry.

Due process requires that a correlation between BMI and sleep disorders be established, in addition to its impact on the general pilot population, and then mitigation strategies be developed. At that point regulatory changes can be instituted to properly address the issue. Now is not the time to wantonly enact sweeping changes that have consequences that cannot even be measured. Thank you for addressing this situation before it has become critical.

If you think this power grab ends at a BMI of 40, or even just concerning BMIs then you are sorely mistaken. If you care to take no action... why even comment on the post and waste everyone's time?

I liked the idea of screening for Sleep Apnea, I just thought that they could pre-empt the whole sleep study and SI routine using a low cost machine method of screening and preemptive compliance by use of a CPAP machine. Bring in the tracings from the CPAP when you come in for your physical and it's done.

Calling for Tillman's resignation and saying he has some vendetta is just raving crap.

Personal vendetta might be extreme, but I suspect he has a vested interest (ie financial gain/kick back...etc) in the method of implementation. The method (and cost) of implementation and the ultimate goal of having 'all pilots screened' is what sounds fishy to me.
 
The most insane part of this entire proposal is the fact the medical certification branch is 55,000 cases behind in their SIs. Talk about a group in over their head wanting to take on even MORE?? My student has been battling them for a Third Class for 11 months now, with no end in sight, and is probably one of the healthiest people I know!! They're just out of control.

Good Day,

Sad to see that this has gone the way of greatest resistance. Sleep Apnea is a problem. The solution to get people treated is to use a protocol besides the full sleep study and SI process to deal with it. The result we seek is to get those with OSA on a CPAP machine. The good thing is that most CPAP machines are recording machines with the ability to report results.

The best solution as I see it is to offer a non SI preemptive option. "If you fall into the screening criteria and bring in the recordings of the CPAP machine showing compliance with use and efficacy, you can be issued on the spot with no SI." This brings the cost of compliance down to a few hundred dollars from a few thousand dollars making it much more palatable and will achieve the desired result of getting affected airmen treated.

Couldn't disagree more. The FAA is but one small arm of an over reaching government. Seems to me that Mr. tillman's effort is an exertion of that power. Pilots will always do stupid things, including flying when tired or on medications or with medical conditions they are aware of but have not disclosed. Not everything can be regulated. Freedom has certain risks. Freedom comes with risk.
