Would you consider the term hundred dollar hamburger to be in public domain? It's claimed to be copyrighted, yet, it's used everywhere - your thoughts? I just want to know if I can legally use it as a reference to say what I'm doing on a website. Maybe even commercially. It would only be a reference, not the name of anything in particular.

Yeah Andrew, I think so too - ha. Better hurry and copyright it. (c)

Who's claiming copyright of the phrase "hundred dollar hamburger"?

The following is posted by the copyright folks at http://www.copyright.gov/help/faq/faq-protect.html

How do I copyright a name, title, slogan or logo?
Copyright does not protect names, titles, slogans, or short phrases. In some cases, these things may be protected as trademarks. Contact the U.S. Patent & Trademark Office, 800-786-9199, for further information. However, copyright protection may be available for logo artwork that contains sufficient authorship. In some circumstances, an artistic logo may also be protected as a trademark.

this says it all: http://en.wikipedia.org/wiki/Talk:$100_hamburger

I contacted him and he resorts to name calling when I simply asked if the term was copyrighted - senility? Didn't know it was such a sensitive subject with him. Now I just use the plethora of other sites listing these places. I had a nice offer for him, oh well.

I think he's got lots of sensitive subjects. I once had a "discussion" with him about why he was the only user-review database site in the world that doesn't stamp a date/time on the user submissions. I could practically see the spittle flying across the monitor screen. I was not impressed, either by him or by his website.

At least he *did* give me money back without any problems.

terrible business man - very condescending. website looks like it was done in MS word.
