    Talk to an accountant or tax lawyer first. They will tell you how long you need to live to recoup the expenses. IMHO, cash in the bank is usually better. It gives you more options.

    If your plane is tied down at said FBO, you probably have a tie-down agreement. Check and see if there's a disclaimer in there that protects the FBO. I think a decent lawyer would give you a quick answer to who is responsible.
