When to say.. Unable

Seems to me that the industry wants pilots to not be concerned with paperwork and has been singing the no paperwork tune if you declare.

Yep, you basically have Carte Blanche at that point. People always seem to worry about declaring; I've never had it end with more than a call to the tower but then I've never used it to settle a conflict with ATC either.
