A big part of this is the patent process. You make an application and it can (and frequently does) take seven (7) years to get a patent. You cannot protect an application, and because the process is so anti-applicant, you really don't want to bring outside attention to the application. So you come up with an idea, make an application, and then ignore those who "violate" the concept. Then if you are granted the patent you go back for damages.
