Although the report says the American pilots share some of the blame through negligence, the report is placing very significant amounts of the blame on the Brazilian ATC staff.

If the Legacy crew were cleared to that altitude and heading, how could they be at fault at all? Equally, the 737 was not at fault since it would have been flying as cleared.

The common denominator is ATC. One thing I've not seen released is a copy of the ATC transcripts.
