Does the local Sheriff have jurisdiction over the National Airspace? No. Whatever charges are brought will have to be through the FAA or other entity having jurisdiction over the National Airspace.

Just my opinion.

What does the Sport CFI ticket have to do with anything? Any Private Pilot should know perfectly well it’s illegal, too. Lets call all of them names too, right?

A private pilot doesn’t teach regulations to students.
 
Wow, he must have been flying really low if they could identify him as the pilot.

Not saying he wasn't flying the plane, but I wonder if they're identifying him as the owner of the airplane and therefore looking for him assuming he was flying. He probably was, but it could have been someone else. If I was going to do something that stupid, I wouldn't fly my own airplane.

There's also the possibility that he was at the correct altitude because your average person in a crowd can't really tell how high up a plane is.
 
There was a Sheriff's helicopter patrolling the event. I assume that's how that got the tail number and altitude. I have a friend that was there and they had concerns about how close he got to the helicopter.

This seems like over reach by local law enforcement if it's real at all.

I was thinking the same things when I first read this. I'd really like to hear the rest of the story, and not from a fairy tale writer.

If it was flythebeach, I wonder if he was a short distance off shore where it would be legal. I’ve seen a couple of YouTube videos from flythebeach Seareys.

Earlier in this thread (Post #4) I made the assertion that the local Sheriff has no jurisdiction over the National Airspace. Tommy G., in Post #6 cited a Florida Statute which seems to contradict my opinion. Local statutes attempting to affect the National Airspace have been written all around the country; however, as far as I know, these statutes all have been shot down when tested before a Federal Court considering the primacy of the FAA and their role in managing the National Airspace. I'm not a lawyer, but I have had experience while working for a large local government that tried its best to shut down an unsafe operation at one of its airports. Although pilot complaints had been made about the unsafe operations, and such operations had been witnessed by local law enforcement personnel, there was nothing to be done, unless a violation was witnessed by an FAA Official. Tragically, the unsafe operations ceased upon the crash of the owner's airplane, killing him and five others.

Laws are written by lawyers and litigated by lawyers, thus ensuring a steady trade in interpreting law. I don't claim to understand the nuances of various laws, and now that I'm retired, I hope to not ever need the services of a lawyer. I could go on and on about laws and lawyers, but I won't.

Just as an example of the the primacy of the FAA over issues involving the National Airspace, take a look at this case:

Note that as a result of this case, the City of South Lake Tahoe, California was authorized only to take calls on noise complaints and to attempt to educate a noisy operator if that operator was based at Lake Tahoe Airport. All complaints about unsafe aircraft or drone operations must be made to the Reno FSDO.

The one I liked was the commercial pilot who dropped parachuters into a high school football game then bused the stadium with an FAA inspector in the stands.
 
All them folks that were there and a reported concert at the same time and nobody got a video clip? As Joey would say, "Come on man! Here's the deal!" :rockon:
