The Justice System, so-called, does not care about common sense or reasonableness, or guilt for that matter; LEOs and their partners in the DA's office only care about how many pelts they can collect. The number of arbitrary and conflicting laws in this country are a form of tyranny. If the Man wants you, it's easy.
 
In which case he wouldn't be arrested for DUI (at least in Texas), since part of the statute involves a 'public roadway', so there may be some information the OP is omitting or some other mistake of fact.
I was arrested for a felony DWI in Texas in a parking lot for moving a vehicle 5 feet. Never left parking the parking lot. If the public can enter, it is not private anymore

Ouch! Unless things have changed since the jury I sat on, that would be the third DUI conviction. I think your first two attorneys may owe you a partial refund for not being clear that business parking lots were also a no drive zone.
